Hi, I'm aware that the creation and selling of a "Hackintosh," is technically illegal, largely b/c of this clause in the Mac OS EULA:
" I. Other Use Restrictions. The grants set forth in this License do not permit you to, and you agree not to, install, use or run the Apple Software on any non-Apple-branded computer, or to enable others to do so. Except as otherwise permitted by the terms of this License or otherwise licensed by Apple: (i) only one user may use the Apple Software at a time, and (ii) you may not make the Apple Software available over a network where it could be run or used by multiple computers at the same time. You may not rent, lease, lend, sell, redistribute or sublicense the Apple Software. "
However, my question is not regarding traditional Hackintosh. My question pertains to taking a computer produced by Apple, such as an iMac or MacBook, and using the hardware within that device. For example, if the main logic board from a broken MacBook were transplanted into a new case - with absolutely no modifications to the underlying electronic components (just a new cosmetic appearance). Due to there only being cosmetic changes, I thought that such a device would be legal to produce and sell (as Apple-produced Mac products can be re-sold), but I wanted to reach out to others to learn more.
In such a scenario:
- Is the creation of such a device legal for personal use?
- Would the sale of such a device be legally allowed?
TL;DR: If the hardware from a MacBook/iMac/etc. is placed in a new case, is this "hackintosh" of sorts: a) legal to own for personal use, and b) legal to sell?
Note: I have NOT produced such a device at this time, nor have I attempted to sell any such device. In fact, I am not even in possession of an iMac, MacBook, or any other Mac device. This is just a hypothetical question I'm curious about.
